These Terms and Conditions ("Terms") govern your use of the AdaptLocal AI text-back service ("Service") operated by AdaptLocal ("we," "our," or "us"). By signing up for or using the Service, you agree to these Terms.

1. Program Description

Program Name: AdaptLocal AI Text-Back

AdaptLocal is an SMS-based AI text-back service designed for local service businesses. When your customers call and you can't answer, our AI automatically sends them a text message and handles the full conversation — including answering questions about your services, pricing, availability, and scheduling appointments. The AI is trained specifically on your business information and responds on your behalf via text message.

SMS Messaging Disclosure

Message Frequency: Message frequency varies based on customer interactions with your business. Customers who text your AdaptLocal number will receive automated AI-generated responses for the duration of their conversation. Business owners receive daily summary messages and alerts based on their plan settings. Typical usage ranges from 5–50 messages per day depending on business volume.

Message and Data Rates: Standard message and data rates may apply. Message frequency varies. Carrier fees are the responsibility of the message recipient.

Text STOP to any AdaptLocal number to opt out of messages at any time. You will receive a confirmation message and no further messages will be sent.

Text HELP to any AdaptLocal number for support information, including our contact details and instructions for opting out.

Participating Carriers: Compatible with all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others.

Opt-In: Customers opt in to receiving messages by initiating a text conversation with your AdaptLocal number or by calling your business when missed call text-back is enabled. Business owners opt in during the account setup process.

Data Sharing: We do not share, sell, or provide mobile phone numbers or SMS opt-in data to third parties or affiliates for marketing or promotional purposes. Mobile information collected as part of the AdaptLocal SMS program will only be used to deliver the AI text-back service described herein.

2. Service Plans and Pricing

AdaptLocal offers the following subscription plans:

All plans include a 14-day free trial. Prices are subject to change with 30 days' notice to active subscribers.

3. Free Trial

New accounts receive a 14-day free trial. You may cancel at any time during the trial period without being charged. If you do not cancel before the trial period ends, your selected plan will begin and your payment method will be charged automatically.

4. Billing and Cancellation

Subscriptions are billed monthly. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle — you will retain access to the Service until that date. We do not offer refunds for partial months.

AdaptLocal uses artificial intelligence to generate text message responses on behalf of your business. While we strive for accuracy, AI-generated responses may occasionally contain errors. You are responsible for reviewing your AI agent's responses (available in your conversation history and daily summaries) and notifying us of any inaccuracies. AdaptLocal is not liable for business decisions made by customers based on AI-generated responses.

7. 24-Hour Test Drive

Before your AI goes live with customers, you have the option to test it for 24 hours. During this period, you can text your AdaptLocal number as if you were a customer to verify response accuracy. You choose when to go live. This test period is optional — you may also choose to go live immediately.

8. Data Ownership

You retain ownership of all business information you provide and all customer conversation data generated through the Service. We do not claim ownership of your data. Upon account cancellation, you may request an export of your data within 30 days.

9. Service Availability

We strive to maintain 99.9% uptime for our SMS service. However, we do not guarantee uninterrupted service and are not liable for any temporary outages or delays in message delivery caused by carrier networks, third-party service providers, or circumstances beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, AdaptLocal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, or business interruption, arising from your use of the Service.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, use the Service for illegal purposes, or engage in activity that harms other users or our platform. We will provide notice before termination except in cases of severe or illegal violations.

12. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes via email or SMS at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Arizona. Any disputes arising from these Terms or the Service shall be resolved in the courts of Maricopa County, Arizona.
